1/ Preamble
These General Terms and Conditions of Sale apply to all commercial transactions concerning the items sold by Unique & Unlimited SRL/ BelgaWatch through its website belgawatch.be, to the exclusion of any other conditions (unless expressly agreed in writing and mutually approved by the parties). Placing an order through the website belgawatch.be implies full acceptance of the general terms reproduced below.
2/ Definitions
The terms used in these general terms or on the website belgawatch.be must be understood as follows:
2.1. Unique & Unlimited SRL/ BelgaWatch, whose website is belgawatch.be, where the products are presented and sold to clients.
2.2. Client: Any individual or legal person, legally capable, who places an order for product(s) from Unique & Unlimited SRL/ BelgaWatch via the website belgawatch.be.
2.3. Order: a request by the client to enter into a sales contract with Unique & Unlimited SRL/ BelgaWatch concerning the products presented.
2.4. Product sheet: refers to the information (texts, photos, graphics, category system, etc.) related to a product offered for sale on belgawatch.be.
2.5. Products: all goods offered for sale by Unique & Unlimited SRL/ BelgaWatch through its website belgawatch.be.
2.6. Transaction: all operations, secure processing, authorisations, and agreements inherent to the payment of products ordered by bank transfer on the site.
3/ Acceptance of the conditions
The client acknowledges having read these General Terms and Conditions of Sale and declares, by placing an order, to expressly accept them without reservation. Order validation constitutes acceptance of these terms.
4/ Purpose
Unique & Unlimited SRL/ BelgaWatch offers products for online sale (Article 5). The client connects to the website and places an order for the products selected while browsing (Article 6). Products are paid by bank transfer after receiving a Pro-forma invoice detailing all conditions of the sale. Unique & Unlimited SRL/ BelgaWatch confirms acceptance of the order by email, and products are delivered within a timeframe specified by email upon ordering and after full payment (Article 7).
5/ Products
Only products for which a “product sheet” is available on belgawatch.be may be sold. 5.1. Any consigned item from a client is registered for a minimum of 1 month; after this period, the duration may be renegotiated with the consignor.
6/ Order
6.1. All information provided by the client when entering order data commits the client. Unique & Unlimited SRL/ BelgaWatch cannot be held responsible for any errors made by the client in the delivery or billing address and the resulting delays or impossibility of delivering the ordered products.
6.2. The email sent by the client serves as proof of the nature, content, and date of the order.
6.3. Upon receipt of the order request, Unique & Unlimited SRL/ BelgaWatch confirms acceptance via email to the address provided. The sale is only concluded upon this confirmation.
6.4. In general and without justification, Unique & Unlimited SRL/ BelgaWatch reserves the right to refuse or cancel any order from a customer, particularly in the event of a problem with payment of the order in question or a dispute relating to the payment of a previous order, or when the product in question is no longer available, or simply due to a material error on the site. In the event of non-completion of a purchase, no compensation may be claimed from Unique & Unlimited SRL/ BelgaWatch. Any deposit paid for an order that is mentioned on the Pro-Forma invoice cannot be returned and will not be reimbursed in any way. If the balance of the invoice is not paid by the date agreed by both parties, the deposit is lost and not refundable.
6.5. Only legally capable persons may place an order.
7/ Delivery
7.1. After order confirmation and payment approval, Unique & Unlimited SRL/ BelgaWatch commits to preparing shipment within 2 to 5 business days depending on destination. Unique & Unlimited SRL/ BelgaWatch is not responsible for delays caused by the shipping carrier.
7.2. The client agrees to pay all taxes, duties, and charges related to delivery, present or future. Unique & Unlimited SRL/ BelgaWatch bears no responsibility in this regard.
7.3. Delivery is made either in person at our offices or via DHL or via other international deliveries shipment. Shipping rates and delivery times are communicated by email. No compensation may be claimed for delays.
7.4. Upon receipt, the client must check the condition of the product. Missing or damaged items must be reported immediately to the carrier at the time of delivery.
8/ Transport & Insurance
In general, the transport risk is borne by the customer, Unique & Unlimited SRL/ BelgaWatch’s responsibility being limited to the preparation of the shipment in accordance with the rules of the art and the handing over of the parcel to the shipping company according to the instructions and addresses provided by the customer. At the express request of the customer, Unique & Unlimited SRL/ BelgaWatch can take out insurance covering the risk of loss/theft on behalf of the customer, the cost of this insurance varies between 1,5 and 2.5% of the insured value depending on the destination. In the event of a claim, Unique & Unlimited SRL/ BelgaWatch will reimburse the Client only to the extent of the compensation granted by the insurance company. If the insurance company refuses to compensate the claim, Unique & Unlimited SRL/BelgaWatch will subrogate the Client’s rights against the insurance company so that the Client may act at will towards the insurance company, it being understood that Unique & Unlimited SRL/ BelgaWatch’s responsibility is strictly limited to insuring the parcel in good faith on behalf of the Client.
9/ Price
9.1. Prices shown on product sheets do not include transport and/or insurance fees.
9.2. The price indicated on the order confirmation is the final price, all taxes included, including VAT (on the margin or in full depending on the type of product).
10/ Payment
10.1. Products must be paid in full by bank transfer to the account indicated on the website.
10.2. The order becomes effective only after approval from the secure banking/payment centre. In case of refusal, the order is cancelled, and the client is notified by email.
11/ Delivery acceptance
Delivery (and therefore acceptance) occurs either (i) when collected by hand or (ii)in the store, or (iii) when the carrier’s parcel is accepted (signature).
RIGHT OF WITHDRAWAL (EU CLIENT ONLY)
In accordance with Directive 2011/83/EU, EU-based clients have 14 days from receipt to exercise their right of withdrawal, subject to the directive’s conditions.
NON-EU CLIENTS
For sales made outside the European Union, we do not accept returns or withdrawal requests. All non-EU sales are considered final. In the exceptional event that a return is accepted, it will be subject to a fee of Belgian VAT %, and all return shipping costs will be entirely borne by the customer. In case of withdrawal, only the watch’s sale price will be refunded, excluding shipping/insurance fees (both ways), payment-processing commissions, and any re-import taxes. The watch must be returned in its original cosmetic and functional condition; website photos/videos serve as reference.
12/ Liability
12.1. Unique & Unlimited SRL/ BelgaWatch cannot be held responsible for damages resulting from misuse of products.
12.2. Nor can it be held responsible for changes made by manufacturers.
12.3. The responsibility of Unique & Unlimited SRL/ BelgaWatch will, in any case, be limited to the amount of the order and could not be called into question for simple errors or omissions which could have remained despite all the precautions taken in the presentation of the products. In particular, the photos on the site are provided for information purposes only. Under no circumstances may a modification of the container or content of a product be invoked in the event of a discrepancy in relation to the photo available on the site.
13/ Warranty
13.1. The 12-month guarantee covers breakdowns, hidden defects and the authenticity of the watch. This guarantee is given for use under normal conditions as a “bon père de famille” and in accordance with the characteristics of the model. As mechanical watches are made up of delicate gears and are sensitive to shocks, magnetic fields, condensation, humidity and extreme temperatures, the guarantee does not apply to a malfunction resulting, even partially, from one of these factors. The warranty does not apply to a malfunction resulting from a lack of maintenance or intervention outside the seller’s workshops, with the exception of workshops in the brand’s official network. Unless otherwise stipulated in writing, the warranty does not cover maintenance, servicing, adjustments and other fine-tuning necessary for normal use of the watch (but does cover functional faults and hidden defects), water-resistant and straps, handles, glasses, winding mechanisms, attachments and other accessory parts. The guarantee given is an obligation of means which implies, in particular, that the seller cannot be held liable when a brand refuses to take a watch in for repair due to a lack of available parts. The seller reserves the right to repurchase the watch at the price paid if the guarantee exceeds 5% of the sale price. Unless expressly stipulated otherwise, watches more than ten years old are sold without any guarantee other than that relating to their authenticity.
13.2. Under no circumstances shall Unique & Unlimited SRL/ BelgaWatch be held responsible for non-compliance with the regulatory and legislative provisions in force in the country of receipt. The potential liability of Unique & Unlimited SRL/ BelgaWatch is exclusively limited to the value of the product in question, determined at the date of sale. The customer may contact customer service by e-mail. The terms of the guarantee given on the products are available on each product sheet on the website.
14/ Personal Data
14.1. Collecting personal data is mandatory for order processing. Missing data prevents validation.
14.2. Unique & Unlimited SRL/ BelgaWatch complies with the Belgian law of 8 December 1992 relating to the processing of personal data, revised by the law of 11 December 1998, which takes into account the European directives of 24 October 1995. This law stipulates that the company collecting personal data must have the consent of the person concerned, that the data must be accurate and that it must be collected for a precise, clear and legal purpose. All individuals must have access to their personal data and the right to modify it. In accordance with the law, the processing of personal data relating to customers has been declared to the Commission for the Protection of Privacy. Customers have the right to access, modify, rectify and delete their personal data, which they may exercise by contacting Unique & Unlimited SRL/ BelgaWatch.
14.3. Unique & Unlimited SRL/ BelgaWatch commits to never sharing clients’ data with third parties.
15/ Intellectual Property
Texts, layouts, images, product sheets, and all elements on the website are protected by intellectual property laws. Content may not be copied, modified, or published without written consent.
16/ Disputes & Applicable law
In the event of difficulties in the application of this contract, the customer and Unique & Unlimited SRL/ BelgaWatch reserve the right, before taking any legal action, to seek an amicable solution. Failing this, the courts of Brussels, French-speaking section, shall have jurisdiction, regardless of the place of delivery of the products or the domicile of the customer. Contracts and all legal relationships between the customer and Unique & Unlimited SRL/ BelgaWatch are subject to Belgian law.
